{"id":397,"date":"2023-07-23T00:12:00","date_gmt":"2023-07-23T00:12:00","guid":{"rendered":"https:\/\/privacyand.com\/?p=397"},"modified":"2023-07-17T19:08:09","modified_gmt":"2023-07-17T19:08:09","slug":"failure-is-always-an-option","status":"publish","type":"post","link":"https:\/\/privacyand.com\/?p=397","title":{"rendered":"Failure is Always an Option"},"content":{"rendered":"\n<p>What if a formal model isn&#8217;t possible? <\/p>\n\n\n\n<p>Privacy may be impossible to isolate from other human values and ideals such as trust, justice or spirituality.\u00a0\u00a0Attempting to model it allows for quick (and painless?) failure.   A formal model does not allow for a detailed consideration of, for example, the given harms in an informational disclosure treating those as consequences rather than outcomes (as traditional in legal scholarship on privacy\u00a0(Solove, 2005)).<\/p>\n\n\n\n<p>In any case, a formal model encourages debate on privacy \u2013 regardless of discipline \u2013 allowing for the ability to discuss privacy in a precise and consistent manner.\u00a0\u00a0<\/p>\n\n\n\n<p>Aside from the conceptual nuances, the word \u2018privacy\u2019 itself varies in meaning and rightly so.\u00a0\u00a0Half the world\u2019s population speaks one of 13 languages,\u00a0while the remainder of the world speaks a variety of others.\u00a0\u00a0Computing could be a universal language, and the ability to express traditionally social concepts in computer models is a possible way to move forward in our understanding and shared experiences.\u00a0\u00a0<\/p>\n\n\n\n<p>Failing the application to privacy is nonetheless possible, for example, there are too many definitional complexities, or infinite possibilities of combinations leading to decisions on information disclosure.\u00a0\u00a0Or perhaps a more complex computational model is required to undertake the scholarship.<\/p>\n\n\n\n<p>An effort that fails still matters; it shows that privacy cannot be entirely formalized today, but the important issues of contextual and experiential specificity can be kept alive!\u00a0\u00a0These are questions which are on the cusp of being dismissed before they can well be subjected to inquiry.\u00a0\u00a0<\/p>\n\n\n\n<p><strong>Another justification is the current modality of privacy in tech itself.\u00a0\u00a0<\/strong><\/p>\n\n\n\n<p>Models for implementation of privacy almost solely focus on the ability of the computing system to incorporate legal requirements once an information disclosure has occurred.\u00a0\u00a0For example, now that I have created an email account, there is much work on managing the information I have shared.\u00a0\u00a0However, little or none consider the original mechanisms for collection, or decision making on behalf of the data subject in making the disclosure of their information.\u00a0\u00a0In order to allow such consideration, we have to make privacy speak the language of computing.\u00a0\u00a0If that is simply not possible, then we can end the debate about using legal requirements as a basis for ensuring privacy in computational systems.\u00a0\u00a0<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><em>NB: The top 13 languages spoken by half the world\u2019s population are identified in the Swedish\u00a0Nationalencyklopedin\u00a0include: Mandarin, Spanish, English, Hindi, Bengali, Arabic, Portuguese, Russian, Japanese, Punjabi, German, Javanese and Wu.\u00a0\u00a0English translation courtesy of Wikipedia.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>What if a formal model isn&#8217;t possible?
